Introduction


Welcome to Otolo Homes on YasIsland.com! Otolo Homes is a brand owned by Masarra, providing short term serviced holiday homes rentals in Abu Dhabi.

These Otolo Package Terms and Conditions are supplemental to YasIsland.com Platform Terms and Conditions (above), the Booking Terms and Conditions (above), and the Product Terms and Conditions (as defined hereinafter) ( together "Otolo Terms"). These Otolo Terms govern your access to and use of the YasIsland.com platform, specifically for searching, booking, nd staying in ‘Otolo Homes’ and by making a booking of Otolo Homes through YasIsland.com , you agree to comply with these Otolo Terms.

Plase read these carefully. If you do not agree to these Otolo Terms, you must not use the Platform for booking Otolo Homes. 

 

Dfinitions

  • Booking" refers to a confirmed reservation made by the Guest for Otolo Homes on the Platform.
  • "Guest" or “you” refers to the individual making a Booking for an Otolo Home on the Platform and includes individuals named on the Booking. 
  • "Listing" refers to an Otolo Home advertised on YasIsland.com. 
  • “Masarra” refers to Masarra Destination Management L.L.C. SPC
  • "Otolo Home(s)" refers to short-term holiday home(s) and unit(s) made available on a short term rental basis on the Platform"Platform" refers to YasIsland.com and any associated subdomains or mobile applications. "Product Terms and Conditions" means the apartment specific terms and conditions displayed on the booking page on the Platform at the time of booking an Otolo Home; 
  • "Service Provider" refers to Voyage Vacation Home Rental LLC, the entity responsible for managing and servicing the listed Otolo Homes on the Platform. 
  • “We” or “Us” or “MD” refers to Miral Destinations Sole Proprietorship LLC – operator of the Platform.

Booking Process

Contractual Relationship 

  • When you make a Booking for an Otolo Home through the Platform, you are entering into a contract directly with the Service Provider (Voyage Vacation Home Rental LLC). MD acts solely as a facilitator for booking of Otolo Homes and is not a party to contract between the Guest and the Service Provider. 

Search and Selection 

  • Guests can browse available Otolo Homes, review descriptions, amenities, and pricing before making a Booking. 

Post-Booking Requirements 

  • Identification Documentation and Security Deposit 
  • After your Booking is confirmed, you will be contacted by the Service Provider at your registered email address to provide necessary identification documentation and to pay the required security deposit. 
  • Identification Documentation: All guests must provide valid legal identity documents (such as a passport or national ID issued by a government authority) prior to check-in to the Service Provider. 
  • Security Deposit: The security deposit amount and payment instructions will be communicated via email to the Guest. 
  • Failure to Comply: If the required identification documentation and security deposit are not provided a minimum of 24 hours prior to check-in, the Booking may be cancelled at the discretion of the Service Provider, who will then instruct MD to return any payment made in accordance with [refer to refund clause]

Information Provided by Service Providers 

  • Information about Otolo Homes, including facilities, house rules, sustainability measures, prices, availability, and cancellation policies, is based on what the Service Provider provides to MD to be displayed on the Platform. While we strive for accuracy, we cannot guarantee that all information is complete or error-free and neither MD or its Affiliates shall be liable for any refund or compensation whatsoever in the event of incomplete or inaccurate description of any Otolo Home units booked on the Platform. 

Payment Terms

Rates and Pricing 

  • Additional Charges: Any additional services or amenities may incur extra charges, which will be communicated at the time of Booking or prior to check-in. 

Accepted Payment Methods 

  • Online Payments: Payments can be made securely through thePlatform using our payment gateway using major credit and debit cards including Visa, MasterCard,Apple Pay and PayPal. 

Security Deposit 

  • Deposit: A refundable security deposit may be required by the Service Provider for certain bookings which may be indicated on the booking page which will be required to be paid after your Booking and before the time of check-in. Failure to provide a security deposit may result in denial of your Booking without any liability on the Service Provider and MD. 
  • Purpose: This security deposit covers any damage to the Otolo Homes unit, furniture, fixtures or amenities in the Otolo Homes unit, common areas of the property, potential damages, lost or missing items, late check-out charges, loss of parking card, non-payment for any chargeable facilities utilized by you, any extra charges or levies on your stay and/or excessive cleaning required after your stay, in accordance with the Service Provider’s policy displayed at Otolo Homes units. 
  • Security Deposit Refund Process: The Service Provider shall review the Otolo Home unit for and return any unapplied portion of security deposit to you. Return of the security deposit will be processed 30 days after check-out and will be credited to the original payment method used to provide the security deposit. You are advised to check with your financial institution after the aforesaid period on the receipt of the security deposit (or a part thereof) to your account. In the event of any dispute or disagreement regarding the retention of the security deposit, this should be addressed directly to the Service Provider. MD, Masarra and its affiliates shall not have any liability regarding any disputes pertaining to the security deposit.6.5 Taxes and Fees 
  • Taxes: Applicable local taxes including VAT and services charges are included in the quoted rates.
  • Tax Changes: Should there be any changes in tax laws, we reserve the right to adjust prices accordingly. 

Currency and Exchange Rates 

  • Currency Conversion: If paying in a currency different from United Arab Emirates Dirhams, exchange rates will be applied by your bank or card issuer. 
  • Foreign Transaction Fees: MD, Masarra and its affiliates are not responsible for any foreign transaction fees charged by your bank or financial institution. 

Payment Processing 

  • Authorization: By providing your payment details, you authorize MD to charge the total booking amount to your selected payment method. 

Late or Failed Payments 

  • Payment Deadline: Any failure to make payments including the security deposit payment prior to check-in may result in cancellation of your booking without any liability on the Service Provider, MD, Masarra and/or its affiliates. 

Modifications and Extensions 

  • Additional Charges: Any increase in the booking amount due to any modifications made by the Guest must be paid to the Service Provider by the Guest, at the time such change is confirmed. 
  • Payment for Extensions: Any approved extensions to your stay at Otolo Homes require immediate payment of the additional charges to the Service Provider. 

Promotions and Discounts 

  • Eligibility: Promotional rates or discounts are subject to specific terms and conditions. 
  • Limitations: Discounts cannot be combined unless expressly stated. 
  • Revocation: MD and/or the Service Provider reserves the right to revoke discounts if any misuse or abuse is detected. 

Security and Data Protection 

  • Data Encryption: All payment information is encrypted during transmission using SSL technology. 
  • Privacy Compliance: We comply with applicable data protection laws to safeguard your personal information. 

Receipts and Invoices 

  • Confirmation Email: A detailed receipt will be emailed to you upon successful payment. 

Third-Party Fees 

  • Additional Charges: MD is not responsible for fees charged by your bank, credit card company, or third-party payment gateways. 

Default and Remedies 

  • Default: Your failure to comply with these Otolo Terms constitutes a breach of contract . 
  • Remedies: In the event of your default or breach, we reserve the right to cancel your Booking and seek compensation for any losses, charges, expenses incurred. 

Disputes and Chargebacks

Guest Responsibilities

By booking an Otolo Home unit on the Platform, you agree to: 

  • Provide Accurate Information 
  • Supply accurate details, including your name, contact details, number of guests, room nights, and payment information. 
  • Legal Identity Documents 
  • Provide the necessary legal identity documents (including but not limited to passport or national ID issued by a government authority) required at the time of check-in for all guests. 
  • Compliance with Rules 
  • Comply with all rules and conditions specified in these Otolo Terms and the Service Provider’s policies applicable at the Otolo Homes unit booked by you. 
  • Property Care 
  • Treat the Otolo Home unit, its amenities, its furnishings and contents with utmost care and respect. 
  • Timely Departure 
  • Vacate the Otolo Home unit at the agreed-upon checkout time with the Service Provider. Failure to do so may result in additional charges, which may be deducted from your security deposit, in accordance with clause 6.4 above. 
  • Damage Reporting 
  • Report any damage caused to the Otolo Homes unit, its property, furniture, fixtures, amenities during your stay to the Service Provider promptly and accept liability for such damages. 
  • Compliance with Laws 
  • Comply with all applicable local laws and regulations during your stay, including but not limited to occupancy limits, noise ordinances and moral values. 

Cancellations and Refunds

Guest Cancellations 

  • Cancellation Policy: Cancellations are subject to the Service Provider’s cancellation policy mentioned within the Product Terms, as displayed on the Listing.

Service Provider or MD Cancellations 

  • In exceptional circumstances, it may be necessary for MD or the Service Provider to cancel your booking. If MD or the Service Provider cancels your booking (for a reason other than your breach of these Otolo Terms or the applicable laws) we will refund the Booking amount, less any applicable non-refundable amounts in accordance with the applicable policies. This is the sole liability of MD, its affiliates and the Service Provider and we shall not be liable to pay any compensation or damages of any kind whatsoever to you The Service Provider and MD reserve the right to terminate your Booking immediately without any liability if you breach any of the Otolo Terms or breach the applicable laws. The Service Provider, MD and its affiliates reserve the right to seek damages, compensation or retain the security deposit in the event of any breach by you resulting into cancellation of the Otolo Homes Booking. 

Refunds

  • Booking Refund Processing: Approved refunds of Bookings of Otolo Homes shall be made by MD, subject to cancellation policy and will be credited to the original payment method within 21 days. You are advised to check with your financial institution regarding the receipt of refund into your account after the aforesaid period. You agree to accept the refund as the full and final settlement of any Bookings cancelled hereunder for any reason and agree that MD and its affiliates shall have no further liability for any costs, charges, fees and expenses incurred by you or any other person in relation to the Booking.
  • Non-Refundable Amounts: Certain fees such as the service fee, service charges, taxes and first night's rate, may be non-refundable. 

No Assignment 

  • You may not assign or transfer your booking or any of your rights under these Otolo Terms without prior written consent from us and the Service Provider. 

Property Rules and Policies

House Rules 

  • Each Otolo Homes unit may have specific house rules, such as restrictions on pets, smoking, or parties. 

Non-Compliance 

  • Failure to comply with the Property Policies may result in eviction without a refund or compensation and additional charges for damages or violations. 

Surveillance Devices 

  • The property within which Otolo homes unit is located, may have security cameras in common areas (such as elevators, staircases, lobby) for safety purposes. No devices are placed within Otolo Homes units. By accepting these Otolo Terms, you consent to their use.

Prohibited Activities

As a Guest, you agree not to: 

  • Engage in illegal activities or use Otolo Homes unit for immoral or unlawful purposes. 
  • Smoke inside the Otolo Homes unit; smoking is strictly prohibited inside the Otolo Homes unit. 
  • Have unauthorized parties or events at the Otolo Homes unit. 
  • Sublet or assign your Booking to another party. 
  • Cause damage to the property or the Otolo Homes unit or disturb the peace of the neighborhood. 
  • Add additional guests to your Booking without confirming with the Service Provider. 
  • Use photographs taken at the Otolo Homes Unit or property for commercial purposes without our prior written consent. 

Yas Island Theme Park Tickets Terms and Conditions

Allocation of Yas Island Theme Park Tickets

  • If specified in the Product Terms as package inclusion, Guests with a confirmed Otolo Homes Booking will be eligible to receive one single-Yas Island Theme Park (as defined below) ticket per registered Guest for each night booked
  • Example: A 3-night stay for 4 guests includes 12 park tickets (3 nights x 4 guests). 
  • Yas Island Theme Park tickets are valid only for the dates specified therein and cannot be accumulated or carried over to other dates. 

Usage 

  • Yas Island Theme Park Tickets are non-transferable, non-exchangeable, and cannot be exchanged, resold for commercial gain or given to any other person. 
  • Only registered Guests are eligible to use the Yas Island Theme Park. 

Valid identification matching the Booking details may be required to redeem Yas Island Theme Park tickets. c. Selection of Parks

  • Each single-park ticket grants access to one of the following Yas Island Abu Dhabi theme parks: Ferrari World Abu Dhabi, Yas WaterWorld Abu Dhabi, Warner Bros World Abu Dhabi, Sea World Yas Island Abu Dhabi (“Yas Island Theme Parks”). 
  • Guests can choose which Yas Island Theme Parks to visit on each day, subject to park availability and operational hours. There is no guarantee a Yas Island Theme Park will be available on any particular day. 

Restrictions 

  • Yas Island Theme Parks tickets cannot be used in multiples on the same day. 
  • Lost or unused Yas Island Theme Parks tickets cannot be replaced. Please keep them secure. 
  • MD, Masarra and its affiliates are not responsible for any Yas Island Theme Parks closures or changes in operational hours. 

Compliance 

  • Guests must adhere to all Yas Island Theme Parks rules and regulations , park entry terms and conditions available on the official website, and any ticket terms and conditions set out on your e-ticket or voucher. 
  • The Yas Island Theme Parks reserves the right to deny entry to any guest not complying with its policies. 
  •  

Park Ticket Redemption 

  • Upon Check-In 
  • Upon check-in, you will receive your park tickets or instructions on how to access them. 
  • Identification 
  • Valid identification may be required when redeeming park tickets at the park entrance. 
  • Validity 
  • Park tickets are only valid during your stay dates and cannot be extended.

Additional Services 

  • Booking Confirmation 
  • Any additional services included in your package will be detailed in your Booking confirmation. 
  • Redemption Instructions 
  • Instructions for redeeming these services will be provided upon arrival. 

Liability Disclaimer

Limitation of Liability 

  • To the maximum extent permitted by law, neither MD, Masarra or any of their affiliates are liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Otolo Homes, the services provided by the Service Provider and any direct payments made between you and the Service Provider (for example, the payment and return of the Security Deposit). 

Indemnification 

  • You agree to indemnify and hold harmless MD, Masarra and their affiliates and the Service Provider from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Otolo Homes property. 

Service Provider Responsibility 

  • The Service Provider is solely responsible for the accuracy of the Listing, the condition of the Otolo Homes property, the services mentioned on the Product Terms, collect security deposit and the refund thereof (if applicable) and the provision of accomodation at Otolo Homes unit booked by you. 

Platform’s Role 

  • MD operates the Platform and acts solely as a facilitator and is not a party to the contract between the Guest and the Service Provider formed pursuant to the Booking of Otolo Homes unit on the Platform. 
  • MD, Masarra and its affiliates are not liable for: 
  • The quality, safety, or suitability of the Otolo Homes unit. 
  • Injuries, damages, or losses incurred during your stay. 

Guest Acknowledgment 

  • By using the Platform, you agree that MD, Masarra and its affiliates are not liable for any disputes between Guests and the Service Provider. 

Complaints and Dispute Resolution

Escalation 

  • If the Service Provider fails to resolve the issue, you may escalate it to YasIsland.com. While we may assist in resolving disputes, we are not obligated to mediate or reimburse for any losses, costs, expenses, fees, or amounts that you may incur as a result of such dispute. 

Changes to Bookings

Booking Modifications 

  • For any booking modifications or requests after the booking has been made, you must contact our customer service team directly at reservations@otolohomes.ae or [Phone Number]. Modifications cannot be made through the Platform and require direct communication with our team. 

Service Provider Approval 

  • All modifications are subject to the Service Provider’s approval. 

Additional Charges 

  • Modifications may result in additional charges, which must be paid to the Service Provider confirm the changes. 

Miscellaneous

Severability 

  • If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. 

Entire Agreement 

  • These Otolo Package Terms and Conditions, YasIsland.com Platform Terms and Conditions (above), the Booking Terms and Conditions (above), and the Product Terms and Conditions constitute the entire agreement between you and us regarding your use of the Platform for booking Otolo Homes. 

Waiver 

  • Failure to enforce any right or provision in these Otolo Terms shall not constitute a waiver of such right or provision. 

Force Majeure 

  • Neither party shall be liable for any failure to perform its obligations where such failure is as a result of acts beyond their reasonable control, including but not limited to natural disasters, war, pandemics or other unforeseen events beyond the control of either party.
